Terms of Service

1. Agreement
These Terms form a binding agreement between you and MySmartRental, operated by Coded Vision Design (“MySmartRental”, “we”, “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old and legally able to enter a binding contract. If you use the service on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.
3. Accounts
- Provide accurate, current information and keep it up to date.
- Keep your credentials secret. You are responsible for activity under your account until you report it compromised.
- One person or legal entity per account. Do not share logins.
- We may suspend or close accounts that violate these Terms or applicable law.
4. Roles on the platform
MySmartRental provides different experiences for:
- Landlords and property managers
- Manage properties, tenants, leases, invoices, maintenance, and contractors.
- Tenants
- Pay rent, raise maintenance tickets, and communicate with landlords.
- Contractors
- Receive and update maintenance jobs.
MySmartRental is a platform that facilitates these interactions. We are not a party to the tenancy, employment, or service agreements between users.
5. Fees and payments
- Pricing for landlord accounts is shown on our Pricing page and may change on reasonable notice.
- Rent and invoice payments are processed through Safaricom M-Pesa or other licensed processors. Payment processor fees may apply.
- You are responsible for any taxes, duties, or charges imposed by your jurisdiction.
- Failed payments may trigger automated reminders to the payer and the landlord.
6. Your content
You retain ownership of content you upload (leases, invoices, photos, messages). You grant MySmartRental a worldwide, non-exclusive, royalty-free licence to host, display, and process that content strictly to run the service for you. You are responsible for making sure you have the rights to upload and share what you upload.
7. Acceptable use
You agree not to:
- Break the law, infringe rights, or help others do so.
- Upload malware, scrape the site, or attempt to breach security.
- Use the platform to harass, defraud, or discriminate against anyone.
- Reverse engineer, resell, or white-label the service without written permission.
- Send unsolicited marketing via our messaging tools.
8. Service availability
We work to keep the platform online and performant, but we do not guarantee uninterrupted availability. Planned maintenance will be announced in-app where practical.
9. Third parties
The service relies on third-party providers including Safaricom M-Pesa, our hosting provider, email provider, and error monitoring (Sentry). Their terms and privacy practices apply to their portions of the service.
10. Termination
You can close your account at any time by emailing info@mysmartrental.com. We can suspend or terminate your access if you materially breach these Terms, put the platform or other users at risk, or if required by law. On termination, portions of these Terms that by their nature should survive (payments owed, your content licence for existing data, disclaimers, liability, governing law) will continue.
11. Disclaimers
The service is provided “as is” and “as available”. To the fullest extent permitted by law, MySmartRental disclaims all implied warranties, including fitness for a particular purpose and non-infringement. MySmartRental does not verify, endorse, or guarantee the conduct, listings, or content of users.
12. Limitation of liability
To the fullest extent permitted by law, MySmartRental will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability for claims relating to the service will not exceed the greater of (a) the fees you paid to us in the twelve months before the claim, or (b) KES 10,000.
13. Indemnity
You will defend and indemnify MySmartRental against claims arising from your content, your use of the service, your breach of these Terms, or your violation of any law or third-party right.
14. Changes to the service or Terms
We may change the service and these Terms. Material changes will be announced in the app or by email, and the effective date will be updated above. Continued use after changes take effect means you accept them.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya. Courts of competent jurisdiction in Nairobi will have exclusive jurisdiction over any dispute, unless your local law requires otherwise.
